Quando il rapporto coniugale o di convivenza entra nella sua fase patologica, uno dei coniugi potrebbe lamentare di aver eccessivamente contribuito ai bisogni della famiglia. Si ritiene, infatti, che la crisi familiare non dovrebbe costituire l’occasione per un coniuge di ottenere un premio e, per l’altro coniuge, di subire una penalità: situazione che si verificherebbe se il coniuge, che ha contribuito in misura superiore alla nota regola della proporzionalità, non avesse alcun strumento di tutela. Il volume analizza, anche in chiave comparativa, la possibilità di una parte di ottenere delle “restituzioni”, i relativi strumenti di tutela, anche preventivi, nonché l’eventuale misura della restituzione.
