Il volume affronta il caso Enrica Lexie dalla prospettiva del diritto internazionale prendendo in esame le questioni giuridiche che ne hanno dominato il dibattito: la fondatezza della giurisdizione penale dell’India rispetto al fatto contestato, l’immunità funzionale per gli organi di Stato stranieri operanti in veste ufficiale. Al vaglio è l’applicabilità al caso marò della normativa pattizia e del diritto consuetudinario esistenti. Si giunge a considerare l’ipotesi di giurisdizione concorrente tra India e Italia, mentre non sembra rinvenibile alcun obbligo internazionale che imponga al giudice di New Delhi di riconoscersi incompetente. Esigenze di garanzia di fondamentali diritti umani dei due marò potevano invece costituire un valido motivo per negarne il ritorno in India allo scadere del permesso speciale. Giulia Mannucci, dopo il diploma in lingue moderne, intraprende il percorso universitario in Studi Internazionali e, nel 2013, consegue la Laurea Magistrale in Relazioni Internazionali dopo un periodo di studi in Spagna e un tirocinio formativo a Roma presso il UN-World Food Programme. Recentemente ha svolto un corso di alta formazione per osservatori elettorali di breve periodo presso la Scuola Superiore Sant’Anna.

We have been fortunate in discovering among the members of the D. A. R. One who is a direct descendant of Deborah Sampson, and from whom we have received the family tree which appears in the Appendix. This lady is Miss Amy Greer Thompson of New York, a great-great-granddaughter of our heroine, and the only member of the D. A. R. Who belongs to the Society as representing a female soldier. Others have been admitted as descendants of patriotic women, who rendered substantial services to the cause of Independence, but no one of them can point to a regularly-en listed woman soldier as her ancestor. We regret that the steel plate of Deborah Sampson's portrait cannot now be found, though known to be in Dedham a few years ago; and we are therefore obliged to be content with a half-tone reproduction from the original print.
