Network analysis in law. E-book. Formato PDF Sebastiano Faro   -  Edizioni Scientifiche Italiane - Esi, 2015  -

In the past decade the concept of network has acquired a growinglyrelevant role in the way we conceptualize, study and measurethe world. The computational study of networks in all its declensionshas been entering in a variety of fields including social sciences. This volume brings together researchers from computational socialscience, law and computational legal theory, network scienceand related disciplines to discuss the actual and potential applicationsof network analysis in the legal domain. Law is made by people, about and for people and institutions. These people or institutionscan be seen as networks, moreover law itself forms networks, sourcesof law refer to other sources of law and together constitute (part of)the core of the legal system. All these phenomena can be detected, mapped and analysed in order to get deeper insights about theirstructure, their function and their evolution. The nine contributionscollected in the volume deal with these topics offering an up to dateoverview of the most relevant research strands in this field.Publications in the «Law Science Technology» series will deal, from onepoint of view, with looking more closely at and revisiting classical topicsof Legal Informatics, and from another, at innovative topics arising out ofthe dialogue between legal science and a range of research areas rangingfrom cognitive sciences to complexity science, from computer science tocomputational social science and biological sciences.Radboud Winkels is associate professor in Computational Legal Theory at the LeibnizCenter for Law of the University of Amsterdam, the Netherlands.Nicola Lettieri is researcher at ISFOL (Rome) and adjunct professor of Legal Informaticsat the University of Sannio and of Computational social sciences at the Department ofComputer science of the University of Salerno, Italy.Sebastiano Faro is senior resercher at the Institute of Legal Information Theory and Techniquesof the National Research Council of Italy (Florence).

Law and computational social science. E-book. Formato PDF Sebastiano Faro   -  Edizioni Scientifiche Italiane - Esi, 2013  -

Social sciences are going through a phase of profound change due to three main factors: the resort to computational approaches, the integration, enabled by computational tools, among different disciplines and sciences, and the ever increasing availablity of information in electronic format regarding the most varied aspects of reality. Within the space of a very short time, the new scientific paradigm of computational social science emerged taking the form of an unprecedented intersection among social, information and complexity sciences. The relationship between law and computational social science certainly deserves being developed: the scientific paradigm underlying this emerging research area can focus greater attention by lawyers on the empirical dimension of legal phenomena and greater openness to dialogue with other disciplines, two basic conditions for finding appropriate legal responses to the complexity and dynamism of contemporary society. Moreover, computational social science provides lawyers with methods and tools that seem to be able to offer a new scientific basis for their activities in the various contexts of interpretation and application of the law and also to the processes of policy and rule making. This volume collects contributions from authors with etherogeneous background. Its aims are encouraging lawyers to imagine the application of the methods of computational social science to authentically legal problems and stimulating a reflection on whether and how the law and the way of thinking of a lawyer can be transformed by their encounter with the research paradigm of computational social science.
