Lo studio propone una riflessione sul tema del conflitto collettivo, condotta alla luce della ricostruzione teorica elaborata, in materia, da Gino Giugni: dai suoi primi contributi giovanili, ad una rilettura dell'ordinamento intersindacale, fino al suo fondamentale ruolo nell'elaborazione e il consolidamento dell'unica esperienza legislativa, nel nostro Paese, di regolazione dello sciopero nei servizi pubblici essenziali (la legge n. 146 del 1990 e successive modificazioni). Esperienza sicuramente contrassegnata anche dalla presidenza di Giugni alla Commissione di garanzia. La rilevanza centrale del sindacato e dell'autonomia collettiva, nel sistema di regolamentazione del conflitto, viene posta in tutta la sua evidenza, fino al riconoscimento, per il soggetto collettivo, di una titolarità propria del diritto di sciopero. Su tale profilo Giugni, nonostante l'esaltazione del ruolo dell'organizzazione collettiva dei lavoratori nel suo ordinamento intersindacale, mantenne una ricostruzione dello sciopero come diritto a titolarità individuale.
