Die vorliegende Studie untersucht den Einfluss der Obsorgeregelung bzw. der Inanspruchnahme von Beratung, auf den Stellenwert des „Kindeswohls“, im Bewusstsein geschiedener Eltern. In Österreich trat 2001 das Kindschaftsrechts-Änderungsgesetz in Kraft, wodurch die Obsorge beider Eltern auch nach einer Scheidung zum Regelfall wurde. Zwecks Evaluierung dieses Gesetzes, wurde vom BM für Justiz eine Studie in Auftrag gegeben, in deren Rahmen eine Elternbefragung durchgeführt wurde. Der dabei verwendete Fragebogen enthielt neben mehreren geschlossenen Fragen zur Scheidung, Obsorge und Belastung der Kinder, die Frage nach den Wünschen der Eltern. Die Antworten der Eltern wurden zunächst dahingehend untersucht, ob in ihnen Wünsche thematisiert wurden, die aus psychoanalytisch-pädagogischer Sicht, als für das „Kindeswohl“ förderlich einzustufen sind. Dabei wurde von der Annahme ausgegangen, dass das „Kindeswohl“, wenn es zum Zeitpunkt der Beantwortung im Bewusstsein der Eltern war, generell einen hohen Stellenwert im Bewusstsein der Eltern hat. Anschließend wurde der Zusammenhang zwischen dem derart festgestellten Stellenwert des „Kindeswohls“ im Bewusstsein der Eltern und der Obsorgeregelung bzw. der Inanspruchnahme von Beratung im Scheidungsverlauf untersucht. Schließlich wurde jene (obsorge-/beratungsspezifischen) Gruppe von geschiedenen Eltern ermittelt, für die bewusstseinsbildende Maßnahmen ergriffen werden sollten, um das „Kindeswohl“ verstärkt in deren Bewusstsein zu verankern. Zunächst erfolgt die Darstellung des theoretischen Kontexts der Untersuchung, ehe das Forschungsdesign und das methodische Vorgehen erläutert, sowie die Ergebnisse der Untersuchung präsentiert, interpretiert und diskutiert werden.
