La nuova legge elettorale italiana (novembre 2017) è la sesta nella storia della Repubblica e presenta seri motivi di critica sia per la procedura di approvazione che per la dubbia costituzionalità nel merito. Ciò a parte la scarsa idoneità al raggiungimento dell'obiettivo di garantire una solida e non fragile base per la governabilità del paese. Il voto di fiducia, adottato per l'approvazione della legge nei due rami del parlamento, si fonda su un'interpretazione superficiale e disinvolta delle disposizioni pertinenti dei regolamenti parlamentari, avulsa dallo spirito della costituzione e del suo articolo 72, ultimo comma. La classe politica, che ha elaborato la nuova legge, non solo non ha tratto insegnamento dalle più recenti esperienze politiche, ma ha altresì negletto le linee conduttrici della giurisprudenza costituzionale, ribadite nelle due ultime sentenze in materia, la n. 1 del 2014 e la n. 35 del 2017 (che il presente volume riporta in appendice), che hanno dichiarato la parziale incostituzionalità delle leggi elettorali del dicembre 2005 e del maggio 2015.
