The legal profession has been urged to reflect on the principles of Corporate Social Responsibility (CSR) since the end of the eighties when some blatant human rights violations by transnational companies imposed, on public opinion, the issue of a call to ethics in finance and in the market. The legal profession could not in fact remain insensitive to this phenomenon because of its historical vocation to defend rights and because the activity of the lawyer in modern society is more frequently in contiguity with the company’s activities. Therefore it is believed that alongside CSR there is a social responsibility of the lawyer, not only in promoting, in the case, the respect for the rule of law and the values underlying the European Charters of human and fundamental rights, but also to establish the purpose of the professional activity, alongside the protection of the interests and rights of the assisted party, the protection of the human rights of the individual, of other people, of the society. The proceedings of the Third European Conference in Rome represent a message to lawyers for the realization of this new frontier of professional ethics .

L’avvocatura è stata sollecitata a riflettere sui principi della Responsabilità Sociale dell’Impresa (RSI) dalla fine degli anni ottanta quando talune clamorose violazioni dei diritti umani da parte di imprese transnazionali hanno imposto alla pubblica opinione il problema di un richiamo all’etica nella finanza e nel mercato. La professione forense non poteva infatti restare insensibile a tale fenomeno per la sua storica vocazione alla difesa dei diritti e perché l’attività dell’avvocato nella società modena si svolge sempre più in contiguità con le attività dell’impresa. Si è così affermata la convinzione che accanto alla RSI sussista una responsabilità sociale dell’avvocato, non solo nel promuovere il processo di rispetto dello stato di diritto e dei valori su cui si fondano le Carte europee dei diritti umani e fondamentali, ma anche per stabilire quale finalità dell’attività professionale, accanto alla tutela degli interessi e dei diritti della parte assistita, la tutela dei diritti umani della persona, degli altri, della collettività. Gli atti della III conferenza europea di Roma rappresentano un messaggio agli avvocati per la presa di coscienza di questa nuova frontiera dell’etica professionale.
