Quale rapporto v’è tra atto giuridico e documento? Se è vero che l’agire nel e per il diritto avviene (normalmente) mediante l’esecuzione di atti di linguaggio, è anche vero che spesso, e soprattutto con l’avvento dell’ITC, il linguaggio tende a ridursi a un insieme di dati e informazioni che immettiamo su pagine web e sistemi informatici. Atto giuridico e documento, in particolare il documento informatico, sono il tema del presente lavoro che si muove su due prospettive diverse ma intrecciate tra loro: (i) quella della filosofia del diritto, che offre strumenti potenti per comprendere la struttura logica e profonda del diritto positivo; (ii) quella dell’analisi della concreta disciplina nazionale sul documento informatico, che consente di “testare” la validità scientifica dei concetti elaborati in sede filosofica.
